Terms of Service

The agreement

If you use Chatmons on behalf of a channel, company, or organization, you represent that you have authority to bind that party. “You” includes that party.

These Terms incorporate the Privacy Policy. Paid features also incorporate the disclosures in Play checkout and, for streamers who enable payouts, Stripe’s connected-account terms described below.

The Service

Chatmons is a livestream companion: chat can appear as avatars on a transparent overlay; viewers can join from a browser or phone to walk, chat, fish, fight bosses, visit houses, and buy cosmetics or Boosts; streamers configure the channel from a panel. Connecting a channel is free. Some cosmetics and overlay moments are paid.

The Service is provided as is and may change. Features (including economy rates, catalogs, Boost SKUs, and platform support) can be added, balanced, or removed. Twitch and Kick are supported today; other platforms may follow and are not guaranteed.

We do not host your Twitch or Kick stream. You remain responsible for your broadcast, VODs, and compliance with those platforms.

Eligibility and age

You must be at least 13 years old (or the digital-consent age in your country, if higher) and allowed to use Twitch or Kick. Chatmons is not for children under 13. By signing in you confirm you meet those requirements. We do not collect a separate parental-consent form. Kick may require 16+ in some regions.

To enable payouts, buy as a business, or accept Stripe Connected Account terms, you must be old enough to enter a binding contract and to pass Stripe’s verification — typically 18+. We may refuse or close accounts that fail verification or that we reasonably believe are underage.

Accounts, OAuth, and security

You sign in with Twitch or Kick. You must keep those accounts in good standing and only grant scopes you are comfortable with. You are responsible for activity under your Chatmons session, including Play actions and purchases.

Do not share streamer tokens, overlay URLs, or panel access. The overlay browser-source URL contains a secret. Treat it like a stream key. If it leaks, rotate it in the panel; old overlay tokens will stop working.

We may suspend accounts for security, fraud, or Terms violations. Revoking Chatmons in your Twitch/Kick settings will prevent new API calls with those tokens; ask us if you also want gameplay data deleted.

Streamers

You represent that you control the channel you connect and that you have the rights to display chat as avatars on your stream. You must comply with Twitch or Kick terms, community guidelines, and copyright law.

You decide whether the overlay is on air. You can disable features (for example fishing or jump events) and configure commands. Your live channel is listed in the Chatmons directory by default; you can turn that off in the panel.

Moderation tools act on the platform (timeout, ban, delete) using tokens you or a verified moderator authorized. Chatmons-only sanctions (for example removing someone from the stage) may not equal a Twitch/Kick ban. You are responsible for how mods use the tools you enable. Boss, heist, and certain stage actions stay streamer-only.

The simulation runs on our servers so your streaming software is a browser source, not a game host. You still need a stable overlay scene. We do not guarantee FPS, discoverability, or revenue.

Viewers and Play

Joining Play puts your Chatmon, name, cosmetics, and messages on that stream’s overlay. Assume you are on camera. Do not impersonate staff or the streamer.

Coins, stars, XP, items, and pets are licensed game progress, not cash, not a bank deposit, and not property you can require us to redeem. We may cap earn rates, reject duplicate chat, pause rewards when a channel is offline, and reset progress that was obtained by cheating.

One Play seat per account on a channel is enforced server-side. Bots, multi-boxing to farm, or exploiting bugs is forbidden.

Virtual currency and items

Coins and stars are internal units used to unlock cosmetics, furniture, pets, and similar vanity. They have no fiat value, are not transferable outside Chatmons (except as the game itself allows, for example selling a fish for coins), and are not redeemable for money.

USD purchases grant a limited, revocable, non-exclusive license to use the item in the Service. We may rebalance prices, rarities, or visuals. If we retire an item you bought in USD, we may reasonably substitute an equivalent cosmetic or credit — we do not guarantee perpetual identical art.

We may reclaim items or coins obtained through error, chargeback, or abuse.

Paid Boosts, shop USD, and taxes

Prices are shown in USD at checkout and charged by Stripe. Boosts are overlay moments (for example Spotlight or Super Kick) delivered to the live room. Shop USD unlocks catalog items for your account.

For Boosts, 70% of the listed price goes to the connected streamer in full. Chatmons does not take a second or hidden cut from that 70%. The remaining 30% is Chatmons’ platform fee to host the servers, run the overlay, and keep Chatmons operating. Stripe processes the payment. Chatmons currently pays Stripe’s card-processing fees on this rail, so those costs are not taken out of your 70%. If Stripe Express later applies currency conversion, a payout hold, or a reserve on money already credited to you, that is Stripe’s handling — not an extra Chatmons commission.

You authorize us to charge the payment method you submit and to fulfill the SKU you selected. If the overlay action cannot be applied (for example the room is gone), we attempt an automatic refund of that payment. Once a Boost has played on stream, or a shop item has been added to your account, it is a digital good and is generally non-refundable, except where consumer law in your country gives you a mandatory right, or we decide a goodwill refund is appropriate.

You are responsible for any taxes on purchases. Streamers are responsible for taxes on payouts they receive. We may issue or request tax forms where Stripe or the law requires.

Streamer payouts (Stripe Express)

Payouts are optional. Connecting Chatmons does not require Stripe. If you enable payouts, you ask us to create or link a Stripe Express connected account and to send your Boost share there. That share is 70% of the listed Boost price, in full, as described above.

You choose the country of the connected account when you start Express onboarding. Stripe locks that country after the account is created, so pick a country Stripe Express supports (including Mexico, Spain, the United States, Canada, and much of the EEA/UK). You cannot later switch the account to another country from Chatmons.

You must complete Stripe onboarding, keep your identity information accurate, and accept Stripe’s Connected Account Agreement (and any Recipient or Services Agreement Stripe presents). You also agree that Stripe processes connected-account data under the Stripe Privacy Policy. When you provide personal data in connection with payouts, Stripe receives that personal data and processes it in accordance with Stripe’s Privacy Policy.

Payouts are currently weekly on Monday, with a USD $20 minimum, and only after Stripe has enabled payouts on the account. Timing can slip for verification, holds, disputes, or bank delays. We may pause transfers if we suspect fraud, if the channel violates these Terms or platform rules, or if Stripe instructs us to.

Chargebacks, refunds, and negative balances: Chatmons currently assumes Stripe application-fee and loss-liability settings on this Connect rail. We may recover Boost refunds or dispute costs from future shares, withhold payouts, or invoice you if a payment is reversed after we already recorded your share.

You grant Chatmons authorization to perform platform services on the connected account as needed to charge buyers, transfer your share, refund failed fulfillments, and display earnings in the panel. We will not use Connected Account Data for unrelated purposes.

Your content

You retain ownership of content you submit (chat text, custom command copy, pet names, and similar). You grant Chatmons a worldwide, non-exclusive, royalty-free license to host, reproduce, display, and stream that content as needed to operate the Service — including showing it on the overlay, in Play, and in moderation logs.

You represent you have the rights to that content and that it does not infringe others or violate law. We may remove content and issue sanctions. DMCA or similar takedown notices can be sent to legal@chatmons.com.

Acceptable use

You agree not to:

• Harass, dox, sexually exploit minors, or incite violence. Child sexual abuse material is strictly prohibited and will be reported.
• Cheat the economy, exploit bugs for coins or USD value, or attack the Service (scraping tokens, DDoS, malware, unauthorized access).
• Bypass rate limits or bans; share or leak a channel’s overlay URL (the private browser-source link); or impersonate Chatmons staff.
• Use Chatmons to violate Twitch, Kick, or Stripe rules, including unauthorized copyrighted broadcasts.
• Upload malicious files. Catalog art publishing is restricted to app owners; do not attempt to bypass those controls.
• Use the Service if we have banned you, or from a country where it would be illegal.

Twitch, Kick, and other third parties

Chatmons is not affiliated with, endorsed by, or sponsored by Twitch, Kick, Amazon, Stripe, Railway, Fontshare, Discord, or streaming software vendors unless we explicitly say so. Their trademarks belong to them.

If Twitch or Kick changes APIs, suspends our app, or suspends your channel, parts of Chatmons may stop. We are not liable for platform outages or policy enforcement by those companies.

Embedded players and OAuth screens are those platforms’ properties. You still have to follow their terms while using Chatmons as a companion.

Chatmons intellectual property

The Service, Chatmon characters, UI, catalogs, software, and documentation are owned by Chatmons or its licensors. These Terms do not sell you that IP. You may not copy, reverse engineer (except where mandatory law allows), or resell the Service.

Feedback you send may be used without obligation to you.

Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHATMONS DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the overlay will be uninterrupted, that you will earn money, that coins have value, or that third-party platforms will keep working with us.

Some places do not allow certain disclaimers. In those places, warranties last only as long as required by law.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHATMONS AND ITS OPERATORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, LOST GOODWILL, OR STREAM DISRUPTION, EVEN IF ADVISED OF THE POSSIBILITY.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID TO CHATMONS FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $50. For streamers, amounts paid means platform fees you paid to us (if any), not viewer Boosts routed to you.

Nothing in these Terms limits liability that cannot be limited under applicable law (for example death or personal injury caused by negligence, or fraud, where such a limit is forbidden). If you are a consumer, you keep the mandatory rights of your country of residence.

Indemnity

If you are using Chatmons as a streamer or business, you will defend and indemnify Chatmons against claims arising from your stream, your mods’ misuse of tools, your content, your tax obligations, or your breach of these Terms or of Twitch/Kick/Stripe rules, except to the extent caused by our willful misconduct.

Suspension, termination, and survival

You may stop using the Service at any time and may request account deletion via privacy@chatmons.com. Logging out of Play or disconnecting the channel in the panel revokes OAuth tokens only — it is not a full account deletion.

We may suspend or terminate access immediately for Terms violations, legal risk, non-payment, platform bans, or if we discontinue the Service. We will try to give reasonable notice when we shut down the product entirely.

On termination, licenses to virtual items end. Sections that should survive (including virtual items, paid goods, IP, disclaimers, liability limits, indemnity, and governing law) will survive.

Governing law and disputes

If you are a consumer, you may bring claims in the courts of your place of residence, and nothing here waives non-disclaimable consumer-protection rights (including cooling-off or warranty rights that your law requires for digital content, where they apply).

The operator’s registered legal name and mailing address are available on request at legal@chatmons.com until published here.

If you use Chatmons as a business (including as a streamer receiving payouts), these Terms are governed by the laws applicable to the operator of the Chatmons service, without regard to conflict-of-law rules, and exclusive venue for those disputes is the competent courts for that operator, except where the law requires otherwise.

Before filing a claim, email legal@chatmons.com and allow 30 days to try an informal resolution. We both agree to bring claims only in an individual capacity, not as a class action, to the extent class waivers are permitted where you live. This does not limit your right to file a complaint with a privacy or consumer authority.

Changes to these Terms

We may update these Terms. The date at the top will change. Material changes will be signaled in a reasonable way (website or panel notice). If you continue to use the Service after the new Terms take effect, you accept them, except where the law requires a fresh consent. If you do not agree, stop using the Service and request deletion.
